High Court Verdict On Coup Plot Allegations: Justice Prevails Amidst Controversy

In a stunning turn of events, the High Court in Accra delivered its verdict on the alleged coup plot case, by convicting six individuals and acquitting three other individuals.

The ruling convicted six individuals on counts of conspiracy to commit high treason and committing high treason, while three others, including Assistant Commissioner of Police (ACP) Dr. Benjamin Agordzo, were acquitted.

The case, which has been a subject of intense scrutiny and controversy, reached its climax with the sentencing of Donya Kafui (aka Ezor), Bright Alan Debrah Ofosu, and Johannes Zikpi to death by hanging.

These individuals were found guilty of conspiracy to commit treason and treason, adding a sombre chapter to Ghana’s legal history.

The three soldiers—Warrant Officer II Esther Saan Dekuwine, Lance Corporal Ali Solomon, and Corporal Sylvester Akanpewon—also faced grave charges of conspiracy to commit high treason, leading to their conviction and subsequent death sentences.

The court’s decision has sent shockwaves across the nation, igniting debates on the severity of the punishment.

However, the most noteworthy aspect of the verdict lies in the acquittal of ACP Benjamin Agordzo, Colonel Samuel Kodzo Gameli, and another junior military officer, Corporal Seidu Abubakar.

The court’s decision to absolve them of any wrongdoing raises questions about the credibility of the evidence presented against the accused.

Martin Kpebu, the lawyer for ACP Dr Benjamin Agordzo, in reaction to the court ruling, criticized the Attorney General, accusing him of knowingly mounting a frivolous case against his client.

Lawyer Kpebu argued that from the outset, the Attorney General was aware that ACP Agordzo was merely providing education on lawful demonstrations and the consequences of failing to notify the police in advance.

“The Attorney General knows that he mounted a frivolous case against ACP Agordzo.  From day 1, the Attorney General knew that Dr Agordzo didn’t say anything or wasn’t involved in any coup. He was just educating a group that if you want to embark on a demonstration, this is the way to go – notify the police 5 days ahead of time …If you don’t, there are consequences”.

According to Lawyer Kpebu, the case was an attempt to silence dissent within the ranks of public officers critical of the government’s alleged mismanagement.

Lawyer Martin Kpebu further stated that the acquittal of ACP Agordzo and his co-accused by the High Court has left a stain on the reputation of the Attorney General, with him emphasizing that the outcome of the case by the court would haunt the Attorney General for attempting to gag public officers.

Deputy A-G Defends Legal Process Amidst Coup Plot Verdict

Meanwhile, the Deputy Attorney General Alfred Tuah-Yeboah has stepped forward to defend the legal process.

Lawyer Tuah-Yeboah, a key figure in the prosecution, emphasized the gravity of treason charges, acknowledging the complexity and challenges inherent in such cases.  

The Deputy Attorney General further emphasized the fundamental principles of legal proceedings and highlighted the court’s role in evaluating evidence and reaching a fair and just conclusion, regardless of the outcome.

“A case of treason is not a child’s play and so if you are prosecuting a case of treason, you need to do a lot of work. In criminal prosecution, you may prosecute some and win while you lose others. Those that have been convicted what should they be saying?.

“In prosecution, you go with the evidence, the court is expected to sieve the evidence, weigh it and then come to a conclusion on the matter. If the court concludes the matter, it is either the way of the prosecution or defence – whichever way it goes that is the beauty of the rule of law”.

He thus expressed disapproval of Martin Kpebu’s remarks, the lawyer for ACP Agordzo, who accused the Attorney General of mounting a frivolous case to silence dissent within the ranks of public officers critical of the government.

Mr Tuah-Yeboah urged Lawyer Kpebu to respond to issues as a lawyer, without denigrating the integrity of the Attorney General.

As Ghana grapples with the aftermath of this high-profile trial, questions linger about the thoroughness of the investigations, the reliability of the evidence presented, and the potential misuse of legal proceedings for political purposes.

The nation awaits further analysis and reflection on this landmark case, hoping that justice has indeed been served and that the principles of democracy and free speech remain unscathed.
