High-Ranking Public Officers Urged to Uphold Political Neutrality

The recent public commendation of President Akufo-Addo by the Chief Justice has ignited a firestorm of criticism, particularly from leading members of the opposition National Democratic Congress, who view the accolades as excessively partisan and a threat to the perceived neutrality of the judiciary.

This incident has sparked a broader conversation about the role and conduct of high-ranking public officials in Ghana’s highly polarized political environment.

The opposition’s reaction was swift and fierce. They argue that the Chief Justice’s glowing praise of President Akufo-Addo’s leadership undermines the impartiality expected of the judiciary.

Such endorsements, they contend, erode public trust in the judiciary’s ability to act as a fair arbiter in a democratic society.

The stakes are particularly high given the judiciary’s critical role in upholding the rule of law and ensuring that justice is administered without fear or favor.

In this context, Professor Stephen Kweku Asare, a Democracy and Development (D&D) Fellow in Public Law and Justice at the Ghana Centre for Democratic Development (CDD-Ghana) has underscored the imperative for the Chief Justice and other justices to avoid statements or actions that could be perceived as overly partisan or biased towards any individual, including the President.

He posited that while acknowledging someone’s accomplishments is acceptable, the judiciary must maintain its integrity and independence by steering clear of overly lavish praise or criticism of political figures.

“While acknowledging someone’s accomplishments is fine, it’s essential for the Chief Justice (and other Justices) to uphold the integrity and independence of the judiciary by refraining from overly lavish praise or criticism of political figures”.

Professor Asare’s position underscores a fundamental principle of democratic governance, that the judiciary must be seen as a neutral entity, free from political influence.

He emphasized that the integrity of the judiciary is paramount in ensuring that justice is both done and seen to be done, stressing that any actions that could be interpreted as aligning the judiciary with political interests’ risk compromising such essential trust.

Ghana’s Excessive Partisan Politics

Here, it is important to state that Ghana’s political landscape is notoriously partisan and highly charged, with a history of contentious elections and political rivalries that often spill into the public domain.

This reality as earlier pointed by Professor Kweku Asare should serve as a caution for high-ranking public officers, including members of the judiciary, to refrain from making comments that could be misinterpreted by political actors.

In an environment where political affiliations often dictate public perception, even well-intentioned remarks can be viewed through a partisan lens, further polarizing an already divided populace.

The excessive politicization of Ghana’s politics exacerbates the need for a judiciary that is above reproach. Public officials, especially those in the judiciary, must be acutely aware of the implications of their words and actions.

The Chief Justice’s recent praise of President Akufo-Addo has brought to the fore the delicate balance that must be maintained to safeguard the judiciary’s independence.

From the foregoing, it is without doubt that upholding balance is crucial for the health of Ghana’s democracy and the protection of its democratic institutions.

The uproar surrounding the Chief Justice’s comments serves as a potent reminder of the need for judicial restraint in political matters.

As Professor Asare aptly pointed, maintaining the integrity and independence of the judiciary is essential for justice delivery.

By avoiding overly partisan expressions, the judiciary can better serve its role as a cornerstone of democracy, ensuring that justice remains blind and impartial, thus reinforcing the public’s trust in this vital institution.
