The legal profession is built on the principles of honesty, integrity, and fairness. However, when a legal practitioner induces a defendant to falsify their testimony, it undermines the very fabric of the justice system.

The recent allegations against the Attorney General, Godfred Dame, in the Ato Forson case have sparked a political and legal firestorm.

The claims that the Attorney General asked the 3rd defendant, Richard Jakpa, to falsify his testimony have far-reaching consequences and implications.

Furthermore, should the allegation be substantiated, it suggests that the Attorney General, the highest legal officer in the land, is willing to compromise the truth and subvert the legal process.

Accordingly, this erodes public trust and confidence in the justice system and potentially undermines the rule of law.

Moreover, the allegations put pressure on the Attorney General to resign or be removed from office and if the allegations are proven, it would be a clear violation of ethical and legal standards and would warrant disciplinary action, including removal from office.

Accordingly, Justice Srem Sai, a Law Lecturer at GIMPA, stressed that even ordinary lawyers face severe consequences when accused of such wrongdoing, highlighting the gravity of the situation for the Attorney General, who holds a position of utmost trust and responsibility in the legal hierarchy.

 “When a person, whether lawyer or not, tries to get another person to lie to the court for whatever outcome, there are strict punishments against it. Now making that allegation against no mere a person than the Attorney General is serious… If you ask me, that is how severe it is”.

Likewise, the allegations have political implications. The Ato Forson case is a high-profile political trial, and the allegations suggest that the Attorney General’s office is not impartial. This could lead to calls for political intervention, potentially compromising the independence of the judiciary.

To guarantee a fair trial, Justice Srem Sai recommended the establishment of a commission of inquiry to conduct a comprehensive investigation into the case, including the Attorney General’s involvement, to prevent any bias, partiality, or personal and political agendas from influencing the outcome.

Fairness And Credibility At Risk

Furthermore, the allegations could have far-reaching implications for the trial’s outcome. If substantiated, they may lead to a mistrial or acquittal, potentially weakening the prosecution’s case and hindering the administration of justice, which could compromise the fairness and credibility of the trial.

According to Justice Srem Sai, the cornerstone of criminal justice is unwavering fairness, which is crucial because it affords the accused a sense of satisfaction and assurance that they have been given every opportunity to present their case, thereby upholding the integrity of the legal process.

“Clearly, the things they are saying, everything is showing that this trial has very little fairness in it. Because the presence of the Attorney General alone in the case is enough to tilt the scale. All these backgrounds, meeting significant persons, which the Attorney General himself complained of, it all tells you that, that element of fairness is missing”.

Moreover, the allegations highlight the need for greater transparency and accountability in the justice system. If true, they suggest a lack of oversight and accountability, and potentially a culture of impunity. This highlights the need for greater scrutiny and oversight of the justice system, to ensure that it serves the public interest.

As such, Justice Srem Sai proposed that the most suitable solution would be to order a mistrial, thereby necessitating a retrial, and also, the prosecutor involved in the case should be reassigned to prevent any potential bias or conflict of interest.

However, he observed that the situation is complicated by the fact that the accused, the Attorney General, holds prosecutorial power, making it hard to replace him, as his subordinates cannot be entrusted with the case, without raising concerns about transparency and accountability, given their subordinate relationship.

Accordingly, Justice Srem Sai emphasized that a fair trial can only proceed if there are substantial changes in the leadership of the Attorney General’s Department, highlighting the need for a shake-up at the top to guarantee a just outcome. “In this case, the person who is really in charge must go”, he added.

He also accentuated that the handling of this trial will set a precedent for the country’s commitment to criminal justice, shaping the nation’s reputation for upholding the rule of law and fair trial standards for generations to come.
