Politicians Urged to Exercise Caution in Judicial Commentary

In the wake of the Ambulance trial involving the Minority Leader and former Deputy Minister of Finance under the erstwhile Mahama’s administration, Dr Cassiel Ato Forson, tensions have heightened with leading members of the two main political parties making several controversial remarks.

These comments followed allegations by the third accused person in the trial and businessman, Richard Jakpa against the Attorney-General, accusing him of calling him at odd hours to pressure him into falsifying his testimony against Dr. Forson during cross-examination.

The incendiary remarks from political figures prompted Justice Afia Serwah Asare-Botwe, the trial judge overseeing the Ambulance case, to caution all parties against making politically charged statements.

Justice Asare-Botwe emphasized the importance of maintaining the integrity of the judicial process and avoiding any interference through public commentary that could influence the trial’s outcome.

Amid this backdrop, former Chief Justice of the Republic of Ghana, Her Ladyship Justice Sophia Akuffo in commenting on the vexed matter urged political actors to be more circumspect in their pronouncements on judicial matters.

The retired Justice of the Supreme Court highlighted the need for political actors to base their critiques and discussions on judicial matters on procedural or substantive law rather than subjective impressions.

She stressed that the judicial process should remain free from political manipulation, stating, “Because the judicial process is not a political one, which has become too predictable in this country”.

Political Interference in Judicial Matters

Justice Sophia Akuffo further expressed her concern about the current trend of political interference in judicial matters, which she noted undermines the rule of law and the delivery of justice in the country.

“Politicians should be a little more circumspect in what they say and when they are talking, they should talk based on law, rules, and procedure. Sometimes I may be in the privacy of my room saying you don’t know what you’re talking about, it doesn’t work like that”.

She emphasized that political rhetoric, when not grounded in legal principles, can disrupt judicial proceedings and erode public confidence in the judiciary.

The former Chief Justice’s remarks underscore the imperative for political leaders to exercise restraint and ensure that their public statements on judicial matters are informed by legal knowledge and respect for judicial processes.

Her cautionary remarks are particularly pertinent in high-profile cases like the Ambulance trial, where political narratives can easily overshadow the legal facts and principles at play.

As she earlier intimated, excessive political commentary on judicial matters poses a significant danger to the delivery of justice by eroding judicial independence, damaging public trust, compromising the rule of law, influencing judicial appointments, intimidating judges, and interfering with legal processes.

For instance, political commentary on highly politicized judicial matters often carries an implicit or explicit pressure on judges to rule in ways that align with political views or agendas.

This can lead to bias in decision-making, in which judges may feel compelled to make decisions that appease political entities rather than adhering strictly to the law as well as avoid controversial decisions to evade political backlash, compromising their impartiality.

It is therefore important to state that for a healthy democracy and effective judicial system, it is crucial to maintain a clear separation between political discourse and judicial decision-making to ensure that justice is delivered fairly, impartially, and without undue influence.

As the trial progresses, the call for circumspection from esteemed figures like Justice Akuffo serves as a reminder of the critical need to protect the judiciary from undue political influence.

Ensuring that justice is administered fairly and without bias is fundamental to maintaining the rule of law and upholding the integrity of the country’s legal system.
