Israel is teetering on the edge of isolation as it faces a confluence of legal challenges that threaten its international standing.
Israel finding itself in the crosshairs of the International Criminal Court (ICC) is akin to navigating a diplomatic minefield.
The recent application for arrest warrants against Israeli Prime Minister, Benjamin Netanyahu and Defense Minister Yoav Gallant, alongside three Hamas leaders, is not just a legal maneuver but underscores a growing rift between Israel and the international community.
An ICC arrest warrant against a Prime Minister can have far-reaching consequences, affecting not only the individual leader but also their country’s international standing, internal stability, diplomatic relations.
While Israel remains steadfast in its position, the threat of arrest warrants hangs like the Sword of Damocles over Netanyahu and Gallant, curtailing their freedom of movement and amplifying Israel’s isolation.
Human rights lawyer, Geoffrey Nice called the ICC Prosecutor’s move “a very good move in the right direction” but cautioned that the arrest warrants have not been issued yet.
“Don’t prejudge the issue, it’s an application for arrest warrants by Mr Khan in respect to people on both sides and we wait for the judges decision whether to confirm or not,” he said.
Following Khan’s application for arrest warrants, a panel of pre-trial judges will determine whether the evidence supports their issuing.
Israel is not a member of The Hague-based court, and even if the arrest warrants are issued, Netanyahu and Gallant do not face any immediate risk of prosecution.
Israel’s non-membership in the ICC does little to shield it from the reverberations of Khan’s application.
But Khan’s announcement deepens Israel’s isolation as it presses ahead with its devastating war on Gaza. The threat of arrest could make it difficult for the Israeli leaders to travel abroad.
The specter of arrest warrants not only complicates Israel’s engagement with the international community but also underscores the gravity of the allegations leveled against its leadership.
Moreover, the timing of these developments couldn’t be more precarious. Against the backdrop of a protracted conflict in Gaza, Israel is faced with accusations of human rights violations and war crimes.
The ICC’s intervention adds fuel to the fire, intensifying scrutiny on Israel’s actions and further isolating it on the world stage.
The ramifications of Israel’s isolation are manifold. Economically, it risks deterring foreign investment and impeding its access to global markets. Diplomatically, it undermines efforts to foster regional stability and resolve longstanding conflicts. Socially, it deepens divisions and exacerbates tensions, both within Israel and across the wider Middle East.
Israel must begin to right the wrongs, lest it succumb to the perils of isolation and irrelevance on the world stage.
Biden Comes To Israel’s Defence
United States President Joe Biden has defended Israel against war crimes charges in the world’s top courts.
“Let me be clear, we reject the ICC’s application for arrest warrants against Israeli leaders,” Biden said at a Jewish American Heritage Month event at the White House.
“There is no equivalence between Israel and Hamas,” Biden added. Hours earlier, he had issued a strongly-worded statement saying that the ICC warrants were “outrageous.”
The ICC’s member states are obliged to immediately arrest the wanted person if they are on a member state’s territory.
The US is not a member of the ICC and its “biggest leverage” could be to pressure its allies – mostly European nations which are signatories to the ICC – to not act on the warrants.
Michael Mansfield, an international law expert, said, “The fear I have is the Americans might withdraw funding. They are not members of the ICC but there are all sorts of pressure that they can bring about.”
He added, “ICC member countries should stand ready to resolutely protect the ICC’s independence as hostile pressure is likely to increase while the ICC judges consider Khan’s request.”
