Judge Denies Bail of Oliver- Barker Vormawor and 12 Others

Oliver- Barker Vormawor Apprehended by Police over Fix the Country Demonstration

The ongoing legal battle concerning the bail of Oliver- Barker Vormawor and 12 others has drawn significant attention, particularly regarding the arguments surrounding their perceived risk within society.

It is about the adequacy of the protesters mental health assessments as a result of the fix the country’s Demonstration in the fight against illegal mining (galamsey). 

Attorney Martin Kpebu Esq. who has gone as far as the Supreme Court to seek clarity on these issues and has been actively involved in the case gave a detailed overview of the proceedings that unfolded in court, emphasizing the complexities of the bail conditions and the implications of the charges faced by the defendants.

During the court proceedings, the defense counsel raised critical arguments regarding the nature of the charges raised against the defendants, asserting that they were not flight risks and that the charges were primarily misdemeanors. 

The defense underscored that the defendants should not be viewed as threats, highlighting their rights and the nature of the charges.

In response to these assertions, the prosecution maintained a contrasting stance. They argued that the needed legal proceedings are adhered to.

“The prosecution basically said that, the police are not done with their investigations, and that these people should continue to be kept yes, and that for offenses like these, people should be kept in custody because they are a threat to our society, those were the kind of arguments the prosecution made.”

The prosecution’s argument centered around the assertion that the defendant’s release could jeopardize public safety.

Another pivotal aspect of the hearing involved discussions about the mental health of one of the protesters.

This contention raised questions about the treatment of the mentally ill within the justice system, reflecting ongoing concerns about appropriate care versus punitive measures. The plea for psychiatric assessment highlighted the complexities of mental health issues in the context of criminal charges.

‘They even said that A11 should be taken to the psychiatric because the defense had said that he may have a mental condition one or another so the prosecution response was that ‘my Lord’ then let’s have him locked up in the Psychiatric hospital under the watch of the Police [those were the arguments they presented].’’

Judicial Considerations for Bail Denial

The most significant factor in the judge’s decision to deny bail revolved around the locations of the accused. 

“The judge said the addresses, that’s the key thing for the refusal [ of bail, ] after he said he is not inclined to grant bail, [the issue was that ] the addresses of the accused person are not known… that is the center of his ruling’’.

This decision underscored a critical legal principle, the ability to ensure the defendant’s presence at future court dates is fundamental to the bail decision process.

Kpebu noted the judge’s emphasis on the importance of a stable address in determining bail conditions.

This highlighted a fundamental issue in the bail system, where stability and accountability are vital components.

The court’s deliberations regarding the bail applications of Oliver Barker Vormawor and his co-defendants reveal significant tensions between public safety, mental health considerations, and the rights of the accused. 

The prosecution’s insistence on continued custody based on ongoing investigations and societal threats contrasted sharply with the defense’s arguments for liberty based on the nature of the charges and the defendant’s rights.

Ultimately, the judge’s decision to deny bail was rooted in practical concerns regarding the defendants’ addresses and their potential to flee.

The implications of this case extend beyond the immediate circumstances of the defendants, raising questions about how the legal system navigates the complexities of mental health, societal safety, and the rights of individuals facing charges. As the legal proceedings continue, the outcomes will likely have lasting effects on the defendants and the broader discourse surrounding bail conditions and public safety.
