Strengthening Judicial Independence, Essential for Ghana’s Democracy

Judicial autonomy, or the independence of the judiciary, is fundamental to democratic governance. 

In Ghana, judicial independence ensures that the judiciary can operate without interference from other branches of government, allowing it to serve as a fair and unbiased arbiter of justice. 

This autonomy is essential to uphold the rule of law, protect individual rights, and maintain public trust in the judicial system

Accordingly, Attorney General and Minister of Justice, Godfred Yeboah Dame, emphasized the Constitution’s role as the ultimate foundation of Ghana’s legal system. 

He highlighted that the Constitution vests the Judiciary with the highest judicial authority, enabling it to interpret and enforce laws without interference. 

“In this country, no institution or individual has sovereignty. In accordance with Article 1 of the Constitution, sovereignty resides in the people of Ghana and the Constitution is the supreme law of Ghana. The supreme law of Ghana has vested the Judiciary with final judicial power”.

Dame affirmed that this authority applies universally, meaning that all individuals and institutions, including the President, are accountable to the Judiciary.

This principle reinforces the Judiciary’s independence and its critical role in upholding justice and the rule of law across all sectors of Ghanaian society.

The Attorney General emphasized that every individual or institution in Ghana, including the President, who holds the nation’s highest office, falls under the Judiciary’s authority to interpret and apply the law without exception. 

This underscores the Judiciary’s role as an impartial body, ensuring that no one is above the law. 

He further explained that this principle is foundational to a well-functioning and civilized society, as it upholds the rule of law, fosters accountability, and ensures equal justice for all citizens, regardless of status or position.

Adherence to Constitution Urged 

Furthermore, Godfred Dame emphasized that all institutions in Ghana, regardless of their function or authority, are required to conduct their activities in strict compliance with the Constitution and the nation’s laws. 

He noted that this ensures a unified legal framework under which every institution operates, promoting consistency, transparency, and accountability across all levels of governance.

By adhering to these constitutional standards, institutions reinforce the rule of law, which is essential for maintaining order and fairness in society.

“A default of same will render such procedures liable to be declared by the courts as unconstitutional or illegal. It is as simple as that, and it is non-negotiable.

“We, therefore, have a duty to support the Judiciary in its work, which is fundamental and crucial to the sustenance of Ghana’s democracy”.

The Attorney General also called on the Ghana Bar Association (GBA) to remain vigilant and proactive in safeguarding the judiciary from any attempts to exert unlawful influence or pressure. 

He emphasized that the GBA has a critical role in protecting judicial independence by ensuring that judges can carry out their duties free from interference or intimidation. 

According to him, by standing against such pressures, the GBA not only defends the integrity of the judicial system but also reinforces public confidence in the rule of law and the fair administration of justice in Ghana.

He further warned against “unscrupulous persons who undermine the independence of the Judiciary by tarnishing its image unjustifiably.”

Emphasizing the vital role of the legal community, Dame stressed that preserving the integrity of the judiciary is crucial for upholding the “purity, dignity, and majesty of our courts.” 

He explained that a strong and independent judiciary not only ensures fair and impartial justice but also reinforces public trust in the legal system. 

By safeguarding these principles, the legal community contributes to the overall stability of society, ensuring that the courts remain respected institutions that effectively serve the interests of justice and the rule of law.
