The newly assented Community Service Act, 2026 is expected to ease pressure on Ghana’s prisons while creating an alternative form of punishment for people convicted of minor offences.
Vice Chair of Parliament’s Defence and Interior Committee and Wa West MP, Honourable Peter Lanchene Toobu, explained that the legislation emerged from years of efforts to address overcrowding, rising state expenditure on inmates and weaknesses in the rehabilitation process.
The reform replaces the earlier concept of non custodial sentencing with a structured community service system designed to keep selected offenders outside prison while requiring them to make a constructive contribution to society. Honourable Toobu noted that the previous system could result in people convicted of minor offences being housed alongside serious offenders, potentially exposing them to influences that could undermine rehabilitation.
He outlined how this situation could contribute to repeat offending, raising questions about whether imprisonment was achieving its intended purpose for people who committed less serious crimes. The Vice Chair traced the origins of the reform to discussions that began around 2014, when policymakers started examining alternatives that could reduce the prison population while strengthening rehabilitation.

Under the new arrangement, community service will be supported by a national framework extending through the regions to the district level, creating an administrative structure for supervision and implementation. The National Community Service Secretariat will serve as the central institution, with regional and district structures expected to oversee offenders serving their sentences within communities.
At the district level, community service officers will be responsible for supervising individuals assigned to perform work as part of their sentences. Honourable Toobu acknowledged that the framework would introduce a degree of bureaucracy, but argued that a clear institutional structure was necessary to ensure the legislation worked effectively.
He explained that the system would also operate alongside existing courts, giving judges an additional sentencing option when dealing with eligible minor offences. Previously, courts dealing with such cases were largely restricted to imposing fines, imprisonment or a combination of both, leaving limited room for alternative forms of punishment.
The new legislation changes that position by allowing judges to consider whether an offender can serve a sentence through constructive work within the community. The approach, the Interior Committee Vice Chair indicated, is intended to ensure that punishment also contributes to rehabilitation and community development.
On Benefits Of The Act
He pointed to sanitation and other communal activities as examples of work that could form part of a community service sentence, depending on the circumstances of the case. The system will also provide room for judges to consider the skills of offenders when determining the nature of their assignments.
This flexibility, according to Honourable Toobu, could make community service more meaningful by allowing offenders to use their abilities in activities that benefit their communities. The implementation process is expected to receive additional guidance through a Legislative Instrument, which will establish the rules and regulations required to operationalise the Act.
Honourable Toobu indicated that the regulations would help clarify the responsibilities of the various institutions involved and provide the practical framework needed at the district level. The legislation therefore represents a shift in Ghana’s approach to dealing with less serious offences, moving some offenders away from custodial punishment while retaining judicial oversight.
New Community Service Bill To Generate Revenue
Ghana’s new community service regime could allow the state to generate revenue from the skills of offenders while they serve sentences outside prison, Parliament’s Defence and Interior Committee has disclosed.
The Wa West MP and Vice Chair of the committee, Honourable Peter Lanchene Toobu, explained that the legislation would allow courts to consider an offender’s professional abilities when assigning community service. The approach is intended to transform certain sentences into productive engagements that benefit communities while reducing the financial burden associated with keeping minor offenders in custody.
Under the proposed system, a skilled offender could be assigned work connected to their profession and receive payment for the service, with an agreed portion potentially returning to the state. Honourable Toobu illustrated the concept with the example of a mason who could be assigned to support a construction project as part of a six month community service sentence.
“If you are sentenced for community service, for instance, and you have a special skill, the state will be able to use that your special skill in the area of your community service to generate income.”

The model could therefore create a dual benefit by ensuring that punishment remains rehabilitative while reducing some of the expenses associated with incarceration. Part of the income generated through eligible assignments could be channelled back to government to support the management of inmates and other needs within the criminal justice system.
Honourable Toobu indicated that this would supplement government resources rather than make community service solely dependent on public funding. The legislation also establishes eligibility parameters, with community service intended for offences carrying a maximum sentence of three years.
