Minority Pushes For Legal Reforms In Community Service Bill

The Minority Leader and Member of Parliament for Effutu, Honourable Alexander Kwamena Afenyo-Markin has urged Parliament to increase consultations on the proposed Community Service Bill before its final approval.

The Minority Leader explained that wider engagements through winnowing would help the Parliament build consensus on critical legal concerns raised during proceedings.

Honourable Afenyo-Markin indicated that although the House agreed to suspend proceedings after Clause 13, the opportunity is necessary for further refinement of the bill. He stressed that several proposed amendments require detailed consideration outside the chamber to improve the final legislation.

In his remarks, the Effutu MP pointed to apprehensions surrounding bail conditions and the treatment of persons facing criminal charges. He explained that the bill currently focuses on community service sentencing while leaving significant gaps relating to bail administration and pre-trial justice.

“We need to enrich this law so it addresses onerous bail conditions. Parliament has the opportunity to protect rights through clear legal provisions. The discussion must go beyond punishment after conviction.”

The Effutu MP disclosed that some members of the academic community have engaged Parliament on the possibility of introducing a dedicated Bail Act. He noted that public interest in the matter shows concern over how the justice system handles misdemeanour offences.

Honourable Afenyo-Markin contended that some bail conditions imposed on accused persons effectively operate as punishment before conviction. He explained that individuals charged with minor offences often face excessive terms that undermine confidence in the justice process.

The Effutu MP also advocated legal provisions that would restrict remand in cases involving misdemeanour offences. He suggested that Parliament should clearly define bail protections within the legislation to ensure consistency in judicial application.

The Minority Leader stressed that reforms within the criminal justice system would benefit all citizens regardless of political affiliation or social status. He added that legal safeguards have become important because no individual can predict future encounters with the justice system.

Meanwhile, Honourable Afenyo-Markin appealed to the Majority Leader to create room for bipartisan dialogue before the bill returns to the chamber. He expressed optimism that consensus driven discussions would strengthen the legislation and improve public confidence in Parliament.

He also advised that collaborative engagement between both sides of the House would help produce a more balanced legal framework. He emphasised that careful scrutiny at the winnowing stage would improve the quality and effectiveness of the final law.

Parliament Urged To Address Bail Laws Through Reforms

The Minority Leader, Honourable Afenyo-Markin called for comprehensive legal reforms to address bail anomalies and strengthen protection of constitutional rights within Ghana’s justice system. He explained that Parliament should approach criminal justice reforms as interconnected issues requiring a unified legal framework.

The Effutu MP argued that post conviction relief measures contained in the Community Service Bill shared direct links with pre-conviction custodial practices. He stated that both issues influence fairness within the justice system and deserve equal legislative attention.

“Whether someone is in government or opposition, injustice remains injustice. The law must protect every citizen equally. Parliament has the chance to close the gaps now.”

The Minority Leader referenced judicial pronouncements that have drawn attention to excessive bail conditions imposed by lower courts. He explained that the judiciary itself has provided guidance in previous rulings, creating a legal foundation Parliament could build upon.

Earlier, Honourable Afenyo-Markin notedthat clearer legislation would strengthen public confidence in the country’s democratic institutions. He added that Ghana’s international reputation on human rights require lawmakers to confront challenges within existing laws.

The Effutu MP also cited previous judicial expectations for Parliament to enact legislation regulating constitutional provisions on international commercial transactions. He argued that similar legislative action could now be applied to bail reforms and criminal justice procedures.

Moreover, the Minority Leader stated that politicians frequently express worries about injustice depending on their position within government or opposition and that, legal protections should apply consistently across all political divides.

“Once the law speaks clearly on misdemeanour offences, courts will have guidance on fair bail terms. Citizens will gain confidence that justice remains accessible. That certainty is important for democracy.”

The Effutu MP also appealed for winnowing discussions to allow Parliamentarians to refine proposals before final approval. He suggested that bipartisan cooperation would help Parliament craft legislation capable of protecting future governments and opposition groups alike.
