Legal Practitioner, Mr. Gary Nimako, has intimated that the estranged NDC MP, James Quayson, committed a criminal offence by filling his application as an MP with dual citizenship and needs to be tackled.

Lawyer Nimako stated that the MP was aware of the requirement when applying but still went ahead to do it.

“For me, he has committed a criminal offence and I am sure that the Attorney General will also update them on the full declarations and all other offences he committed at the time he was filing.”

Lawyer Nimako clarified that the information of MPs having dual citizenship is required prior to election during the filing process and as such the MP was aware but indicated that he owed allegiance to Ghana.

The Legal Practitioner indicated that it is also the party on whose ticket the MP was applying’s responsibility to conduct thorough checks on his background to ensure all information provided was accurate.

Speaking on the move by NPP to the Supreme Court to seek an injunction to prevent James Quayson from performing parliamentary duties, he disclosed the move will allow the court deal with the matter before it and bring clarity.

Gary Nimako stated that the MP should help resolve the issue by allowing the court to serve him an injunction, so a decision on the matter can be made.

“But he ought to be served to appear in the Supreme Court to justify why although an injunction has been placed, he is still holding himself as a Member of Parliament.”

Move to get e-levy passed

Earlier, a former Deputy Minister of Information, Felix Kwakye Ofosu, suggested that the move to injunct the Assin North Member of Parliament is intended to get the E-Levy passed. The former Minister stated that the move will suffer spectacular failure.

“So, in a desperate last throw of the dice, NPP Lawyer, Frank Davies, at the obvious instigation of Akufo-Addo is seeking judicial intervention in the passage of the E-Levy by bringing an injunction against the Assin North MP to prevent him from participating in voting in Parliament.”

According to Mr. Kwakye, never has a government displayed such hopelessness and been willing to abuse every process to force hardships on its own people.

“It is the people of Ghana who hate the E Levy. They are up against it, not the NDC.”

NPP’s move to Supreme Court

The New Patriotic Party (NPP) on Tuesday February 1, 2022 went to the Supreme Court of Ghana to compel the National Democratic Congress (NDC) Assin North lawmaker, James Gyakye Quayson, from continuing holding himself as a legislator.

This comes after the Cape Coast High Court, presided over by Justice Coram Kwasi Boakye, had earlier ruled that Mr Gyakye Quayson was not eligible to contest the December 7, 2020 Parliamentary Elections because he had dual citizenship before picking nomination forms from the Electoral Commission, Ghana (EC).

Fresh elections, were as a result ordered to be conducted while Mr Gyakye Quayson was asked to cease from holding himself as MP. However, James Quaye who has been accused of having Canadian and Ghanaian citizenship reportedly goes to Parliament to join in proceedings.
