Lawyer for Bernard Antwi Boasiako (Chairman Wontumi), Andy Appiah Kubi, has cautioned the Attorney General (AG) of the Republic of Ghana, Dr. Dominic Ayine, to be careful in his dealings such that he does not undermine justice in the ongoing court case involving his client and the state.
Lawyer Andy Appiah Kubi expressed his disappointment with how the Attorney General has been handling the case, as he confirmed that they had been served with the notice of withdrawal of the fourth accused person in the case.
The Office of the Attorney General (AG) on Monday, November 3, 2025, officially withdrew all charges against Mr. Edward Akuoko, a manager of Akonta Mining Company Limited and the fourth accused in the ongoing case involving the company and its officials.
Mr. Edward Akuoko, the former fourth accused, together with Wontumi and other officials of the company, has been facing multiple charges, including undertaking a mining operation without a license and felling or abetting the felling of trees in a forest reserve without written authorization, as the law required.

It is understood that Mr. Edward Akuoko will now serve as a prosecution witness for the Attorney General and the state to testify against the Ashanti regional chairman of the New Patriotic Party (NPP) and the other accused persons in the case.
Lawyer Andy Appiah Kubi noted that it was within the remit of the law for the Attorney General to take a decision of that nature, emphasizing that the AG’s decision does not change their legal position on the case.
“We have just been served with the notice of withdrawal of the four accused persons. So, they have come under the rules of court, so they have every right to do so. We are going to prepare our case when they are ready. It doesn’t change our position; we are not guilty. We will come to prosecute the case religiously to the best of our professional expertise.”

He noted the intricate position of the Attorney General, who also doubles as Minister for Justice, emphasizing that it is only right that the AG as Minister for Justice uphold the principles of justice by making sure he does not take decisions that have the potential to influence the decisions of the courts.

“I always sound this warning that we should be careful not to attempt to influence decisions of court. The Attorney General is also Minister for Justice, and his role as Minister of Justice is even more important than his role as the Attorney General and Government Prosecutor because the justice of the moment is so important to every one of us as citizens of the country because our emblem is freedom and justice.”

He lamented that with all the state resources available to the Attorney General, he expected that he would rely on those resources and not one of the accused persons in a case to prosecute the other accused persons.
“If it is just for him to only rely on a former accused person to prosecute a matter against one of the accused persons or some of the accused persons and he thinks that justice may not be undermined, that is his decision.
“I would have thought that his role as Minister of Justice would have persuaded him at all times to be careful that the freedom and the justice of the moment is served also under all the accused persons until they are proven guilty. But the way that the Attorney General appears to be poaching his own accused persons suggests that there is intent to undermine the cause of justice.”

He therefore emphasized that he and his team are focused on defending their client under the rules of the court, adding that they will “resist the oppressor’s rule.”
