Deputy Attorney General and Minister of Justice, Dr Justice Srem Sai, has assured Ghanaians that the Office of the Special Prosecutor will remain intact under a future administration led by President John Dramani Mahama and the National Democratic Congress.
He explained that the position reflects a long-standing policy of the party, which was clearly communicated during campaign engagements. According to him, there has been no intention at any point to dismantle the Office of the Special Prosecutor, stressing that the institution remains essential to Ghana’s democratic governance.
Dr Srem Sai stated that the office plays a critical role in strengthening accountability and ensuring that corruption is addressed effectively. He emphasized that its continued existence is necessary for maintaining public confidence in the country’s anti corruption framework.
Importance of Constitutional Order
While reaffirming support for the Office of the Special Prosecutor, the Deputy Attorney General underscored the need for strict adherence to legal and constitutional processes.
He cautioned that even important institutions must operate within the framework of the law, particularly when issues involve the jurisdiction of the courts.
“You cannot use your wish and desire to subvert a constitutional or a legal arrangement,” he said, explaining that governance must be guided by established legal principles rather than personal or political preferences.
He warned that undermining due process could weaken the rule of law and set precedents that may later produce undesirable outcomes. He added that safeguarding constitutional order is as important as preserving institutions, noting that both are necessary for a stable and functioning democracy.
Dr Srem Sai also addressed concerns arising from public discussions about the Office of the Special Prosecutor, noting that misinformation has contributed to uncertainty about its future.
He called on public officials and stakeholders to provide accurate information and ensure that citizens are well informed about developments involving the office.
According to him, transparency is essential in building trust, particularly in matters related to anti corruption efforts. He stressed that government representatives have a responsibility to keep the public informed and to correct misleading narratives that may distort understanding of policy intentions.
Specialized Role in the Fight Against Corruption
The Deputy Attorney General highlighted the unique role of the Office of the Special Prosecutor in tackling corruption. He explained that corruption is a complex issue that requires dedicated focus, consistent effort, and collaboration across institutions.
He noted that unlike the Attorney General’s Department, which handles a wide range of criminal prosecutions, the Office of the Special Prosecutor is solely focused on corruption related cases. This specialization, he said, makes the office particularly important in ensuring that corruption is not overlooked.
Dr Srem Sai explained that the Attorney General’s Department can still be considered effective even if it does not prosecute corruption cases, as it deals with other crimes such as violent offenses.
However, he pointed out that the Office of the Special Prosecutor is judged entirely on its success in addressing corruption. “They cannot succeed unless they succeed at fighting corruption,” he stated, emphasizing that the office’s mandate is both narrow and critical.
Commitment to Strengthening Anti Corruption Efforts
Reaffirming the position of a Mahama led administration, Dr Srem Sai stated that there is full support for the Office of the Special Prosecutor and its mandate. He described the institution as a crucial part of Ghana’s democratic system and an important tool in the fight against corruption.
He further indicated that addressing corruption requires the collective effort of state institutions, civil society, and the general public. According to him, the administration is committed to ensuring that all relevant institutions are supported in carrying out their responsibilities.
Dr Srem Sai concluded by stressing that the President remains fully committed to fighting corruption on all fronts. He noted that maintaining and strengthening institutions such as the Office of the Special Prosecutor is central to promoting accountability, upholding the rule of law, and sustaining democratic governance.
