The New Patriotic Party, led by its General Secretary, Mr. Justin Kodua has petitioned the Office of the Chief Justice and the Judicial Council, alleging a pattern of selective justice and political persecution targeting its members under the current administration.
In a strongly worded address delivered in Accra on Thursday, August 6, 2026, the General Secretary, Mr. Justin Kodua said members of the party are being “arrested, detained and arraigned capriciously” while persons affiliated with the ruling National Democratic Congress who have been found guilty by courts are being set free.
The petition, submitted on behalf of the NPP, accuses the government of undermining democracy and fairness in the justice system. He said that they were compelled to speak out “for the sake of our country and for the sake of our democracy, justice Is No Longer Fair.”
He said that the party is witnessing a justice system that punishes based on political affiliation rather than the law, ‘‘To the extent that when members of our party arrested, detained, our children’s bill conditions are set forth for them,’’ he stated. The phrase, ‘’children’s bill conditions,’’ was used by him to describe what the party considers excessively harsh bail and bond conditions imposed on arrested NPP members.
The General Secretary, argued that democracy must guarantee equal treatment before the law, regardless of political party.
“We believe that democracy is supposed to ensure fairness. We believe that democracy is to ensure that when someone is finding himself at the wrong side of the law there should be fairness. Irrespective of the political party a person belongs to.”

He further alleged a double standard in how cases are handled. According to him, NPP members face swift arrests and stringent court processes, while some NDC members with convictions are walking free.
“Members of the New Patriotic Party are being persecuted. Where people within the NDC who have committed crime and the court have found them guilty are being set free. This is not the kind of Ghana we all want to see. This is not the kind of Ghana we all wish for.”

Again, the General Secretary said the situation has created difficult moments as a country and called on all stakeholders to protect the democratic gains made since 1992.
“So today we are here to let the whole world know that the Ghana that Jerry Rawlings left, the Ghana that John Agyekum Kufuor left, the Ghana that John Atta Mills left, the Ghana that Nana Akufo-Addo left is not what we are witnessing today.”

He stressed that, they as members of the NPP party are not asking for immunity for any NPP member who has broken the law. Instead, they are demanding that the law be applied equally to all citizens.
NPP Calls On Judicial Council To Protect Democracy
The NPP said that the petition submitted to the Chief Justice is a formal request for the Judicial Council to examine the concerns raised and advise government accordingly. “We believe that this document will not be thrown away but rather the Chief Justice and the Judicial Council will take their time, go through the issues that we have raised and for the sake of our country, for the sake of our democracy they will advise the government,” Kodua stated.
He emphasized that as an arm of government, the judiciary has a constitutional duty to ensure fairness and to serve as a check on the executive and they believe that democracy is supposed to ensure fairness, and it takes all of us to protect our democracy as a people.
The petition came amid growing public commentary about high profile arrests and court cases involving opposition figures. In recent weeks, several NPP members have appeared in court on charges ranging from unlawful assembly to financial offenses. The party claims the timing and manner of the prosecutions suggest political motivation.
He went on to say, the Judicial Council, chaired by the Chief Justice, has the mandate to oversee the administration of justice and make recommendations to improve the system. Whether it will issue a public response to the NPP petition remains to be seen.
He concluded his address by appealing to Ghanaians to remain vigilant in defending democratic institutions. “We want you to know that it bestows on all of us to protect our democracy that we have all suffered to bring to this country,” he said.
The Chief Justice’s office is yet to comment on when the Judicial Council will consider the petition.
