Appeal Court Rejects Chairman Wontumi Bid to Halt Trial

The Court of Appeal has dismissed an application by Bernard Antwi Boasiako, the Ashanti Regional Chairman of the New Patriotic Party, seeking to stay proceedings in an ongoing criminal trial at the High Court. The decision clears the way for the trial to continue, including a directive requiring him to open his defence.

The application was filed after the High Court rejected an earlier attempt by the accused to halt the case pending an appeal. By escalating the matter, Chairman Wontumi sought relief from the appellate court, arguing for a pause in proceedings while the legal challenge to the High Court’s ruling was determined.

However, the Court of Appeal found no sufficient basis to grant the request. It ruled that there were no exceptional circumstances to justify staying the trial, reinforcing the principle that criminal proceedings should not be unduly delayed unless compelling reasons are presented.

The ruling marks a significant development in one of the high profile cases currently before the courts, placing renewed focus on the substance of the charges and the defence that Wontumi is now required to present.

Unauthorized Concession Dealings Case

The dismissed application relates to the first of two criminal cases involving Wontumi and his company, Akonta Mining Limited. In this case, he is charged alongside the company and one of its directors, Kwame Antwi, with six counts linked to unauthorized dealings in mineral concessions.

Prosecutors allege that Wontumi permitted mining activities on a concession in Samreboi without the required approval from the appropriate authorities. The charges include assigning mineral rights without authorization and facilitating unlicensed mining operations.

The High Court had earlier ruled that the prosecution had established a case requiring the accused to respond, prompting the order for Wontumi to open his defence. It was this directive that triggered the legal challenge, as his legal team sought to halt proceedings pending appeal.

Following the Court of Appeal’s decision, the trial is expected to proceed without further delay. The development comes shortly after the Deputy Attorney General and Minister of Justice, Justice Srem Sai, urged the High Court to convict Wontumi based on the evidence presented so far.

Forest Reserve Encroachment Charges

Separate from the Samreboi case, Wontumi is also facing a second criminal trial involving allegations of illegal mining within a protected area. This case relates to activities in the Tano Nimiri Forest Reserve, where he and four others are accused of engaging in mining operations in violation of environmental and mining laws.

The charges in this matter include seven counts, reflecting the seriousness of alleged encroachment into a designated forest reserve. Authorities contend that the activities caused damage to a protected ecosystem, raising broader concerns about the environmental impact of illegal mining.

A notable development in this case is the decision by one of the accused, Edward Akuoko, to cooperate with the prosecution. His charges were subsequently dropped after he agreed to testify as a witness against Wontumi and the remaining defendants. This move is expected to strengthen the prosecution’s case as proceedings continue.

Together, the two cases place Wontumi at the center of ongoing legal scrutiny related to illegal mining, an issue that has drawn significant national attention due to its environmental and economic implications.

Bail Conditions and Ongoing Investigations

Wontumi has been granted bail totaling GH¢25 million across both cases. As part of the conditions, the High Court placed him on a stop list at all entry and exit points in the country, effectively preventing him from traveling outside Ghana while the trials are ongoing.

In addition to the current charges, the Deputy Attorney General has disclosed that Wontumi is under further investigation by the Economic and Organised Crime Office. This separate line of inquiry reportedly involves allegations related to international organized crime, fraud, and money laundering.

While details of this broader probe remain limited, its existence adds another layer to the legal challenges facing the NPP regional chairman. It also underscores the seriousness of the issues under examination by state authorities.

Legal and Political Implications

The Court of Appeal’s decision to dismiss the application to stay proceedings reinforces the judiciary’s stance on ensuring that criminal trials proceed efficiently. By declining to halt the case, the court has signaled that procedural challenges should not be used to delay substantive adjudication without strong justification.

For Chairman Wontumi, the ruling means that attention will now shift fully to the merits of the cases against him. As he prepares to open his defence, the proceedings will test both the prosecution’s evidence and the credibility of the responses presented.

The cases also carry political significance, given Wontumi’s position within the ruling party. However, the courts have maintained a focus on legal principles, emphasizing the need for due process and adherence to established judicial procedures.

As the trials continue, the outcomes are likely to have implications not only for the individuals involved but also for ongoing efforts to address illegal mining and strengthen regulatory enforcement in Ghana.
