Kofi Bentil, Vice President and policy analyst at IMANI Africa, has issued a scathing indictment against the government and the Minerals Commission regarding the alarming surge in armed mine seizures across the country.

His critique centers on the forcible taking of the Northern Ashanti Mine asset, an operation worth tens of millions of dollars that is owned and managed by indigenous Ghanaian medium-scale miners.

Kofi Bentil condemned the regulatory body for acting in a surprisingly cavalier manner to undermine domestic investments, questioning the administrative integrity of state agencies that override statutory mandates.

He further asserted that such aggressive actions could not take place without political backing, highlighting how state power is being deployed to decimate local capital rather than nurture indigenous enterprise.

“DEAR GOVERNMENT/MINCOMM, LET US RESPECT ORDER AND DUE PROCESS. The recent spate of mine seizures by armed persons is not right!! These mines are worth tens of millions of Dollars, AND THEY BELONG TO AND ARE RUN BY INDIGENOUS GHANAIAN MEDIUM-SCALE MINERS!!!”

Kofi Bentil,

Expanding on the regulatory breach, the IMANI Vice President revealed that the Minerals Commission routinely issues plain and bland termination letters, completely ignoring the elaborate legal processes legally required for revoking or terminating mineral rights.

Even after affected indigenous mining firms submit formal petitions detailing how their lease cancellations violate established statutory guidelines and pursue legal injunctions in court to protect their investments, administrative authorities bypass judicial processes.

In direct violation of proper legal procedures, security personnel and armed entities are dispatched to take physical control of the concessions. This heavy-handed approach has enabled foreign interests, including Chinese operators, to take over active mining operations on disputed sites while legitimate local concession holders are displaced.

Escalating Administrative Arbitrariness in Ghana’s Extractive Sector

The arbitrary takeover of commercial concessions highlights a growing governance crisis within Ghana’s natural resource administration. The deployment of armed groups to settle administrative mineral disputes bypasses established constitutional channels, creating severe legal uncertainty for capital investments.

Kofi Bentil warned that these state-sanctioned property intrusions reflect operational breakdowns typically found in failed states, where rule of law is subordinated to political force. When statutory protection is ignored, medium-scale operators lose investment security, chilling local enterprise development in extractive value chains.

The institutional breakdown is compounded when administrative agencies ignore pending court processes.

When mining companies seek judicial intervention against flawed revocation notices, summary armed takeovers undermine judicial authority.

This procedural disregard destroys asset value, disrupts commercial operations, and leaves domestic investors vulnerable to arbitrary state actions. Protecting property rights through predictable, transparent enforcement mechanisms remains essential for maintaining economic stability and investor trust within the domestic mining industry.

The Contradiction of Mine Localisation Policies

The forced seizure of local concessions exposes a fundamental mismatch between public policy statements and regulatory actions.

While state sector agendas emphasize local content, indigenous equity, and domestic participation, regulatory actions actively dismantle successful Ghanaian-owned operations.

Indigenous medium-scale operators, who serve as critical links for domestic wealth creation and technical capacity building, face systemic expropriation while foreign entities move in to operate on disputed concessions.

This contradiction harms national development objectives. Displacing indigenous capital in favor of unaccountable foreign operators damages economic sovereignty, weakens local supply chain integration, and impoverishes local mining communities.

Building a resilient national economy requires regulatory agencies to support local investors, uphold legal protections, and ensure local ownership initiatives are backed by genuine policy enforcement rather than token declarations.

Imperative for Statutory Reform and Institutional Oversight

Reestablishing institutional integrity across Ghana’s extractive sector requires systemic reform of mineral rights administration.

The regulatory oversight system must enforce strict compliance with statutory cancellation processes, removing arbitrary political influence from lease management. Comprehensive oversight mechanisms are necessary to hold regulatory officials accountable when they bypass statutory protocols or violate court orders.

Protecting local investments requires clear legal safeguards that prevent armed interventions during pending legal disputes.

Securing concession rights, maintaining judicial independence, and protecting indigenous businesses from extrajudicial seizures are necessary steps to restore regulatory trust. Ghana must align its sector management with constitutional principles to foster an equitable, law-based mining industry.
