Prosecution Failed To Build Strong Case Against Tamakloe — NPA CEO

According to Chief Executive Officer of the National Petroleum Authority (NPA), Godwin Edudzi Tameklo, the prosecution team handling the case against former Chief Executive Officer of the Microfinance and Small Loans Centre (MASLOC), Sedina Tamakloe, failed to present a strong case. He argued that the Court of Appeal’s decision to acquit and discharge the former MASLOC boss shows weaknesses in the legal process that led to her conviction.

The lawyer explained that the appellate court carefully examined the charges brought against Mrs Tamakloe before arriving at its decision. He noted that the outcome demonstrated that the prosecution’s handling of the matter lacked the level of preparation expected in a case involving an individual’s freedom.

Mr Tameklo emphasised that the former Attorney General, Godfred Dame, who supervised the prosecution during the earlier stages of the case, did not approach the matter with the required seriousness. He argued that legal proceedings involving criminal allegations must be built on strong evidence and proper evaluation of the charges.

“The former Attorney General Godfred Dame did shoddy work on this issue. You cannot sacrifice the freedom of an individual based on political expediency.”

The NPA Chief Executive explained that the Court of Appeal did not merely dismiss the case without consideration but assessed the substance of the charges before reaching its conclusion. He stressed that the judgment showed the importance of ensuring that criminal prosecutions meet the required legal standards.

Additionally, Mr Tameklo rejected the suggestion that political considerations should influence criminal proceedings. He emphasised that the justice system must protect individual rights while ensuring that persons accused of wrongdoing receive a fair hearing based on evidence.

According to him, the decision to acquit and discharge Mrs Tamakloe served as a reminder that prosecutors carry a significant responsibility when presenting cases before the courts. He indicated that errors in criminal trials could have serious consequences for individuals whose liberty depends on the outcome.

Turning to the nature of the charges, the lawyer highlighted that the appellate judges examined the allegations brought against the former MASLOC Chief Executive before reaching their judgment. He explained that the court’s assessment raises questions about the effectiveness of the prosecution’s approach.

“The defective charges were less than 10. The judges evaluated the merits of the charges. You did shoddy work, poor work.”

Mr Tameklo further argued that public confidence in the justice system depends on ensuring that prosecutions are handled professionally and without external influence. He added that cases involving public officials must still follow the same legal principles applied in all criminal matters.

Freedom Should Not Be Lost For Political Reason

The acquittal and discharge of former MASLOC Chief Executive Officer Sedina Tamakloe has been welcomed by Godwin Edudzi Tameklo, who argued that the case raises important questions about protecting individual freedoms within Ghana’s justice system. He added that no person’s liberty should be affected by political interests or considerations.

The NPA Chief Executive described the Court of Appeal’s decision as a necessary correction after the former MASLOC boss spent years defending herself in court. He explained that criminal cases must focus on evidence and legal principles instead of political calculations.

Mr Tameklo argued that the outcome of the case showed why prosecutorial decisions must be handled with caution, especially when they involve the freedom of citizens. He emphasised that the justice system must remain independent and ensure that every accused person receives a fair opportunity to defend themselves.

Addressing the wider implications of the judgment, the lawyer noted that public officials accused of wrongdoing must still benefit from constitutional protections. He explained that holding public office does not remove an individual’s right to due process and proper legal consideration.

Furthermore, Mr Tameklo welcomed the Court of Appeal’s assessment of the evidence presented during the trial. He indicated that the ruling reinforced the importance of ensuring that criminal allegations are supported by convincing evidence before a person is punished.

The legal practitioner also criticised attempts to interpret the judgement through political lenses. From his perspective, the decision should be viewed through the standards of justice and the responsibility of prosecutors to establish cases beyond reasonable doubt.

Meanwhile, the Attorney General’s decision to challenge the Court of Appeal’s ruling at the Supreme Court has kept the matter active within the legal system. The State has filed an application seeking a stay of execution of the appellate court’s decision pending further proceedings.

On this matter, Mr Tameklo’s position remains that the focus should be placed on the legal issues surrounding the case instead of political arguments. He argued that allowing political considerations to influence criminal matters could weaken confidence in state institutions.
