Dr. Anthony Fauci’s Attorney has condemned a U.S. Senate committee’s decision to hold the former top infectious disease official in contempt of Congress, describing the move as a politically motivated effort to punish his client for exercising his constitutional rights.
David Schertler, Fauci’s lawyer, issued a strongly worded statement after the Senate Committee on Homeland Security and Governmental Affairs voted along party lines today to approve a contempt resolution against Fauci.
The measure follows Fauci’s appearance before the committee last week, during which he invoked his Fifth Amendment right against self-incrimination more than 100 times while declining to answer lawmakers’ questions about his handling of the COVID-19 pandemic.
Schertler rejected the committee’s action, arguing that Fauci acted within his constitutional rights and accusing Republican Senator Rand Paul of using the proceedings to pursue a long-standing personal campaign against the former public health official. “Today’s partisan committee vote is a crude political stunt intended to punish Dr. Fauci for exercising his constitutional rights,” Schertler said.
“The Senate should reject Senator Paul’s meritless and politically-motivated contempt resolution. For years, Senator Paul has proclaimed to anyone who would listen that Dr. Fauci should be prosecuted and put in prison. Dr. Fauci has committed no crime – and Senator Paul knows it.”

Schertler also characterised the contempt vote as “a continuation of Senator Paul’s personal vendetta against Dr. Fauci, who spent 50 years in public health and has saved countless lives.” He further accused Paul of attempting to “weaponize the Justice Department” by pursuing the contempt referral.
The committee’s vote came one week after Fauci repeatedly invoked the Fifth Amendment during testimony before the panel. The constitutional protection allows individuals to decline to answer questions if they believe their responses could be used against them in criminal proceedings.
Fauci explained his decision in a statement issued after the hearing, saying he believed there was a genuine possibility that his testimony could expose him to legal risk. He said he feared criminal charges because of what he described as Senator Paul’s determination “to get me to say something, anything, that could vindicate his repeated public pledges that I end up, in his words, quote, behind bars, unquote.”
Committee Chairman Rand Paul defended the contempt resolution, arguing that Fauci could not legitimately invoke the Fifth Amendment because he had already received a presidential pardon from former President Joe Biden. “Dr. Fauci faced no risk of federal prosecution,” Paul said at today’s hearing. “All he had to do was tell the truth,” he added.
According to Paul, Biden’s pardon covered Fauci’s actions from 2014 through the date it was granted, eliminating the possibility of federal criminal liability for matters under review by the committee. However, the pardon does not extend to potential state-level prosecutions or to any future allegations that Fauci provided false testimony under oath.
Paul has indicated that he intends to send the contempt referral directly to the U.S. Department of Justice rather than seeking approval from the full Senate, a move that has drawn criticism from Democratic lawmakers.
Peters Expresses Concerns
Meanwhile, the committee’s ranking Democrat, Senator Gary Peters of Michigan, questioned both the legal basis for the referral and its broader implications for congressional oversight.
Peters warned that punishing witnesses for invoking constitutional protections could discourage future testimony before Congress.
“If this committee now seeks to punish a witness for asserting their constitutionally protected Fifth Amendment rights, future witnesses will argue that appearing before Congress exposes them to punishment regardless of whether they comply with a subpoena and invoke a constitutional protection.”

Legal experts note that a congressional contempt referral does not automatically result in criminal charges. If Paul proceeds as planned, the matter would be referred to the U.S. Attorney in Washington, who would determine whether to open an investigation or pursue prosecution.
The dispute has also revived debate over the scope of Fifth Amendment protections, particularly for witnesses who have received presidential pardons. While Republicans argue that Biden’s pardon removed any reasonable fear of federal prosecution, Fauci’s legal team maintains that other legal risks remained, justifying his decision to invoke the constitutional privilege.
The latest development marks another chapter in the long-running political scrutiny surrounding Fauci’s role during the COVID-19 pandemic. Once the face of the U.S. government’s public health response, Fauci has remained a frequent target of Republican criticism over pandemic policies and federal health guidance.
Whether the Justice Department ultimately acts on the referral remains uncertain. For now, the committee’s vote has intensified the legal and political debate over congressional authority, constitutional rights and the limits of legislative oversight.
