Critical Minerals Boom Demands Reform of Mining Tax Incentives – IISD

Viola Tarus, policy adviser for tax and extractives at the International Institute for Sustainable Development (IISD), has called on African governments to urgently reconsider the fiscal concessions granted to foreign mining companies amidst the accelerating global rush for critical minerals.

Speaking at the 11th African Tax Administration Forum (ATAF) and African Tax Research Network (ATRN) Annual Congress, Tarus warned that poorly designed tax incentives serve as a net drain on host nations.

She emphasized that these revenue leakages deprive mineral-rich African states of critical public resources needed for sustainable infrastructure and social development, all without providing a necessary trigger to attract incoming capital investment.

“Evidence shows that tax incentives in the mining sector are a net burden. Why do we still continue to give incentives in the mining sector, even though evidence suggests that they are not useful?”

Expanding on this imperative, the ongoing transformation of the global energy architecture has placed sub-Saharan Africa at the center of international supply chain strategies.

As demand spikes for cobalt, lithium, manganese, and nickel minerals essential to powering green technology, battery storage, and electric vehicles governments face a pivotal moment to restructure fiscal terms before fresh investment contracts lock jurisdictions into disadvantageous legal frameworks.

Historically, blanket tax holidays and royalty exemptions were granted under the assumption that tax breaks were prerequisite incentives for multinational capital.

 However, empirical assessments reveal that such generous concessions yield diminishing economic returns while systematically weakening domestic tax bases across the continent.

Mining Is Different

The core of the policy argument rests on the fundamental economic distinction between extractives and other industrial sectors.

Traditional manufacturing or service enterprises possess high international mobility, allowing corporate entities to shift operations swiftly across international borders in response to lower corporate income tax rates or subsidies.

 In stark contrast, geological deposits are entirely location-specific; a rich seam of critical minerals cannot be relocated to a neighboring jurisdiction simply because a foreign government offers a more lenient fiscal regime.

Consequently, foreign investors must accept the localized geology, granting host nations significant leverage to negotiate equitable revenue-sharing terms without fear of capital flight.

Nevertheless, mining projects require immense capital expenditure during the preliminary exploration, feasibility, and developmental phases well before commercial extraction generates positive cash flows.

Recognizing these distinct cash flow timelines, IISD argues that any granted incentive must be narrowly targeted toward genuine cost recovery rather than broad-based tax exemptions.

Cost-based incentives such as targeted capital allowances, accelerated depreciation schedules, or duty refunds on heavy machinery directly alleviate initial development burdens.

Conversely, broad-based tax holidays merely reduce corporate tax obligations during profitable production years, handing foreign corporations’ excessive windfalls while failing to resolve early-stage operational constraints.

Critical Minerals Raise Stakes

The rapid escalation of global decarbonization targets has amplified the financial consequences of poorly structured mining codes.

As automotive manufacturers and industrial conglomerates scramble to secure long-term off-take agreements, African nations risk repeating historical fiscal mistakes by offering tax waivers to attract investors who are already bound by resource location.

Once incorporated into national legislation or bilateral investment treaties, blanket incentives become legally stabilized, creating long-term fiscal obligations that prevent host states from capturing resource rents even when global market prices surge.

Removing these entrenched provisions poses significant legal challenges, as attempts to modify existing stability clauses frequently risk triggering costly international arbitration.

Consequently, tax policy advisers urge finance ministries and revenue authorities to act proactively during the current influx of negotiations.

Establishing standardized fiscal regimes and eliminating discretionary tax exemptions before finalizing long-term concession agreements prevents multinationals from playing neighboring countries against one another.

By securing fair tax terms upfront, mineral-exporting states ensure that domestic economies derive tangible public revenues alongside private sector profitability.

The Race For Investment

To maximize fiscal returns, African nations must dismantle the destructive regional paradigm of tax competition.

For decades, competitive undercutting commonly characterized as a “race to the bottom” has seen sovereign governments lower tax burdens and grant extensive fiscal waivers in a frantic attempt to outbid neighboring states for foreign direct investment.

This fragmentation allows multinational entities to optimize their global tax liabilities while host nations surrender millions of dollars in potential public revenue.

Addressing this structural vulnerability requires unified regional governance and standardized fiscal benchmarks across regional economic communities.

 By aligning tax expenditure frameworks, eliminating statutory tax holidays, and adopting robust transfer pricing rules, African states can collectively retain the economic value of their natural resource wealth.

As the critical minerals transition reshapes global trade dynamics, strategic tax reform remains the most viable pathway to turn resource abundance into sustainable domestic development.
