MIIF Announces Implementation of New Mineral Royalties Regulations

The Minerals Income Investment Fund (MIIF) has issued a notice to inform holders of mining leases, restricted mining leases, small-scale mining licences, stakeholders, and the general public of the enforcement of the new Minerals and Mining (Royalties) Regulations, 2025 (L.I. 2517), which governs the payment of mineral royalties across Ghana’s extractive sector.

Having officially come into force on March 10, 2026, L.I. 2517 legally establishes the precise applicable royalty rates and standardizes the procedural framework through which royalty payments are to be calculated and remitted in respect of all minerals mined within the sovereign territory of Ghana.

This statutory intervention marks a structural transition away from legacy payment systems, seeking to align state revenue generation directly with real-time global commodity cycles while establishing operational clarity for large-scale concessions and commercial producers across the nation’s resource landscape.

“The Minerals Income Investment Fund (MIIF) wishes to inform, holders of mining leases, restricted mining leases and small-scale mining licences, stakeholders and the general public, of the new Minerals and Mining (Royalties) Regulations, 2025 (L.I. 2517), governing the payment of mineral royalties in Ghana. The Minerals and Mining (Royalties) Regulations, 2025 (L.I. 2517), came into force on March 10, 2026. L.I. 2517 prescribes the applicable royalty rate and the way royalty payments are to be made in respect of minerals mined in Ghana.”

Expanding on this regulatory overhaul, L.I. 2517 formally replaces Ghana’s historical non-small-scale gold royalty structure with an equitable sliding-scale framework designed to respond dynamically to market realities.

Under the former legislative regime, non-small-scale gold mining entities remitted royalty payments governed by a rigid flat framework that failed to capture upside value during international commodity booms.

Under the newly implemented L.I. 2517 sliding scale, gold royalty rates for non-small-scale operators dynamically scale from a base rate of 5 percent when market prices are up to 14660763 33ad 4801 b408 ed67c957df4e,500 per ounce.

Furthermore, the regulation fixes small-scale gold mining operations at a streamlined royalty rate of 2 percent, replaces the former flat rate of 5 percent on small-scale gold operations with price-linked equity mechanisms where applicable, and introduces specialized sliding scales for critical transition minerals such as lithium ranging from 5 percent at prices up to US3723890f 80c4 4241 a203 64bcf5a2e62d3,000 per tonne while setting a flat 5 percent rate for diamond, bauxite, manganese, salt, industrial minerals, limestone, and iron ore.

The core philosophy underpinning L.I. 2517 relies upon a progressive sliding-scale framework that explicitly links legislative royalty rates to the prevailing market prices of mineral resources, creating a buoyant tax structure that automatically adjusts upward or downward in response to global price swings.

Under the procedural provisions outlined in L.I. 2517, statutory compliance mandates require that “royalty on account is payable to the Republic within fifteen (15) days after the end of each month,” computed on gross revenue generated from the sale or disposal of extracted minerals.

Additionally, leaseholders must maintain administrative oversight by submitting a mandatory “monthly report on royalty accrued and payments made on account to the Republic” directly to the Commissioner-General of the Ghana Revenue Authority (GRA).

MIIF explicitly cautions that “all holders of mining leases, restricted mining leases and small-scale mining licences are reminded of their obligation to comply with the royalty payment and reporting timelines set out in L.I. 2517,” emphasizing that full institutional adherence is mandatory across all tier-one concessions and small-scale operations nationwide.

By enforcing stringent compliance timelines alongside rigorous reporting mechanisms to the GRA, the state effectively eliminates revenue leakage and administrative bottlenecks that historically delayed resource income collections.

Maximizing Economic Value Capture and Resource Wealth Liquidity

From a macroeconomic perspective, the adoption of a price-linked sliding scale guarantees that Ghana captures “a fair share of the economic value generated during periods of high prices,” resolving the long-standing fiscal dilemma where state royalty receipts remained stagnant even as global spot prices hit historic highs.

In periods of heightened commodity inflation, the automated escalation up to a 12 percent royalty ceiling for gold and lithium provides an immediate fiscal cushion for the national treasury, directly translating external market windfalls into sovereign capital.

Conversely, during market downturns, the lower royalty floor of 5 percent provides operational relief to extraction companies, ensuring project viability and preserving capital investment across vulnerable concession holders without jeopardizing long-term tax revenues.

Moreover, including critical energy transition minerals like lithium under the sliding-scale schedule positions Ghana as a forward-looking jurisdiction capable of monetizing the global green transition.

By setting progressive thresholds for spodumene concentrates up to 12 percent, the state secures maximum economic rent from green energy metals before raw exported commodities undergo foreign refining.

This fiscal foresight provides MIIF with an expanded balance sheet to execute strategic co-investments in local mineral beneficiation, downstream processing plants, and critical mining infrastructure, effectively transforming non-renewable natural resources into sustainable economic assets for future generations.

Strengthening Fiscal Sovereignty and Sustainable Development Financing

The institutional implementation of L.I. 2517 substantially strengthens Ghana’s fiscal sovereignty by elevating MIIF’s capacity to leverage royalty streams into long-term capital investments, infrastructure funds, and national development projects.

By securing higher fiscal returns during gold bull markets, the state can channel dedicated capital into localized development programs, mining community development funds, and environmental reclamation initiatives aimed at restoring lands degraded by illegal extraction activities.

Furthermore, establishing clear, statutory royalty rules for industrial minerals such as bauxite, manganese, and iron ore at a unified 5 percent rate provides predictable cost projections for major industrial development projects across the country.

Ultimately, the enforcement of L.I. 2517 establishes a modern, transparent, and equitable resource governance framework that harmonizes sovereign developmental needs with private capital viability.

“Members of the public and industry stakeholders requiring further clarification on royalty payment under the sliding scale regime may direct enquiries to the Minerals Income Investment Fund and the relevant government agencies,” signaling MIIF’s commitment to maintaining open administrative dialogue throughout this transitional era.

Through this legislative transformation, Ghana reinforces its position as an attractive, stable destination for responsible foreign direct investment while asserting sovereign authority to ensure its mineral wealth yields tangible, lasting prosperity for all citizens.
